DHS Alternative Procedure for E-Verify and the March 31 re-inspection deadline

The Department of Homeland Security has introduced an "Alternative Procedure" for E-Verify participants that allows remote document verification — a meaningful change for employers managing a workforce that includes remote hires.

For employers participating in E-Verify, the Alternative Procedure permits remote document verification through video calls or other remote methods. This is a standing option for E-Verify employers, available outside the in-person physical inspection that the pre-pandemic I-9 process required.

A near-term deadline matters as well. March 31, 2026 is the cutoff for re-inspection of physical documents for remote hires brought on during the pandemic. Employers that relied on the temporary remote-flexibility allowances during the pandemic period need to ensure that the corresponding physical inspections are completed before that date to avoid violations on audit.
